- Prior to being called to the Bar, I practiced as an attorney in private practice and in the capacities of senior in house legal Counsel with the South African Power Utility (ESKOM) where I managed a team of Lawyers and with the Small Business Development Corporation of South Africa. In my practice I am briefed by and work closely with a number of the large Laws firms and their international associated law firms. I have a sound knowledge of the above fields of practice including the negotiating and arbitrating based on FIDIC, NEC 2& 3, and JBBC and GCC form of Contracts. In addition I have sound knowledge of general commercial law and been involved in negotiating and drafting a variety of complex agreements. I have been involved in inter alia;
- The successful negotiation and drafting of the FIDIC contracts for the construction of two of the largest coal fired power stations in South Africa, • Successfully arbitrated in Mozambique in regard to an oil and gas service contract off the Mozambican coast, Successfully conducted an arbitration
- concerning a pump storage electrical generating scheme against an Italian – South African Joint Venture entity,
- Successfully negotiated contracts for the procurement, financing and construction of wind turbines projects on behalf of the South African Power utility,
- Conducted arbitration and litigation in respect of numerous construction, energy and commercial matters,
- I was a guest speaker at the school of architecture and engineering at Wits University on Construction Law and disputes.
- Member of the Environmental Impact Assessment evaluation Team for South Africa’s Nuclear Build programme.
- Appointed as a consultant to COWI consulting Engineers and Planners of Denmark. SPECIAL ASSIGNMENTS: (1995) contracted by the UN Centre for Human Rights (Geneva) to conducted training for non-governmental organisations in Mongolia; Made submission on the Bill of Rights section of the South African Constitution to the Constitutional Assembly. Member of technical team to review and critique the Draft Bill on the Truth and Reconciliation Commission In 1994 I was seconded to the Independent Electoral Commission as the Deputy Presiding and Counting Officer during the first Democratic elections held in South Africa in 1994. Worked as consultant to the Department of Marine Resources on the re allocation of marine resources to small fisher folk in order to begin the process of transformation in the fishing industry. 2008 & 2009:
- Appointed senior legal advisor at the Electricity Supply Commission (ESKOM) in South Africa and was quickly promoted to Chief legal advisor and Team leader. • Negotiating and drafting Various FIDIC and NEC contracts for procurement and construction of power stations and their components, wind farms and international finance. March-June 1998- 2007:
- Appointed as independent consultant to the Ford Foundation (New York) under the auspices of INTERIGHTS of the UK to undertake a review of the Southern African Human Rights Network –based in South Africa, Zimbabwe, Botswana, Zambia and Tanzania. This included a “cross border mapping” study of Human rights promotion and protection activities by NGOs and regional institutions in Southern Africa.
- Appointed Co- General Manager of KAGISO-COWI Environmental And Development Consultants.
- Appointed local consultant on mid-term review of DANCED project (The Greenhouse Peoples Project)
- Appointed local consultant on DANCED Design Mission in SA on the Environmental Litigation Project for the Legal Resources Centre.
